Senator Koran, Chair, called the Legislative Audit Commission Executive Subcommittee meeting to order at 1:03 p.m. The purpose of the meeting was to:
  • Discuss and consider adoption of a performance evaluation plan and procedures for conducting performance evaluations of the Legislative Auditor and Deputy Legislative Auditors.
  • Consider appointing James Nobles to be Legislative Auditor for a six-year term ending November 17, 2025.
  • Consider appointing Christopher Buse and Judy Randall as Deputy Legislative Auditors for the Financial Audit Division and Program Evaluation Division, respectively.

Senator Koran began the meeting, stating that a quorum was present. Representative Hansen explained the chronology of the original proposal and the amendments that were put forward. Representative Hansen moved the policy 2019-PR(003) for the performance evaluation plan and procedures. Senator Rest then made an oral amendment to 2019 PR(003) for members’ consideration. With no further discussion, the oral amendment passed and was adopted. Senator Koran asked for further discussion on the evaluation proposal.

Members discussed different aspects of the policy, including evaluation timeline and the comprehensive nature of the evaluations.

Senator Rest moved an oral amendment. The amendment carried.

Senator Klein then offered an oral amendment. Senator Rest moved Senator Klein’s oral amendment. The amendment carried.

Representative Pierson requested that the members reconsider the evaluations taking place after the anniversary and suggested that perhaps the evaluation process take place a month preceding the appointment anniversary. Representative Hansen renewed his motion that 2019-PR(003), as amended, be recommended to pass to the full commission with the request that Representative Pierson work with counsel on developing language to achieve his intent. The motion carried.

Senator Koran moved the consideration of the Legislative Auditor, James Nobles, for reappointment. Mr. Nobles thanked the commission for their consideration of his request to be reappointed and presented his experience, work, commitment, standards, and goals to the members.

Senator Klein thanked Mr. Nobles for his eloquence, dedication, and work. Senator Rest expressed appreciation for the work of all three OLA leaders. Representative Hansen asked Mr. Nobles some questions about special reviews; Mr. Nobles responded.

Representative Hansen asked OLA to consider having formal tribal consultation training. Mr. Nobles welcomed the suggestion and committed to doing that.

After additional member discussion, Senator Klein motioned for James Nobles to be appointed Legislative Auditor for a six-year term ending November 17, 2025, and Deputy Auditors Christopher Buse and Judy Randall to also be appointed.

Senator Klein withdrew his motion and motioned instead the recommendation of appointment of James Nobles to a six-year term to the full LAC. Motion carried with one abstaining vote.

Senator Klein motioned for the recommendations of Christopher Buse and Judy Randall as deputy legislative auditors to the full LAC.

Representative Hansen asked Mr. Buse and Ms. Randall to respond to the suggestion for training around tribal consultation and if there is a need for a third deputy for special reviews. Mr. Buse said he supports the tribal training efforts. Ms. Randall said she also supports the training for tribal consultation. Ms. Randall said that having a third deputy for special reviews would require additional consideration. Senator Rest said a third deputy would require a statutory change.

Senator Klein then renewed his motion to approve Mr. Buse and Ms. Randall as OLA deputies. Motion carried.

Representative Hansen asked members to review the A2-HRD amendment before the next meeting.

Senator Koran adjourned the meeting at 3:12 p.m.
